Terms and Conditions of Sale – Republic of Ireland

These Terms and Conditions of Sale (“Terms”) apply to purchases of physical goods made by consumers through the Moira Dublin online store for delivery to addresses in the Republic of Ireland.

Please read these Terms carefully before placing an order.

Nothing in these Terms excludes, restricts or limits any mandatory rights available to you under the Consumer Rights Act 2022 or other applicable Irish or European Union consumer protection legislation.

Moira Dublin currently sells and delivers products to consumers in the Republic of Ireland.

These Terms apply to consumers. A consumer is an individual acting wholly or mainly for purposes outside that person’s trade, business, craft or profession.

Irish distance-selling rules require the trader’s identity, geographical address, telephone number and email address to be provided to the consumer before purchase. 

2. Product Information

The main characteristics of each product are described on the relevant product page.

We take reasonable care to ensure that product descriptions, photographs, measurements, colours, materials and other information displayed on our website are accurate.

However, colours may appear slightly different depending on your screen, device, lighting and display settings.

Minor differences in appearance that result solely from normal screen or photographic variation do not affect your statutory rights.

If the goods supplied are materially different from their description or otherwise do not conform to the sales contract, your statutory consumer rights continue to apply.

All products are subject to availability.

3. Product Safety Information

Products offered by Moira Dublin are intended to comply with applicable product-safety requirements.

Where required by applicable European Union product-safety legislation, including the General Product Safety Regulation, relevant product information will be displayed on the product page, product, packaging or accompanying documentation as appropriate.

This may include:

  • Product identification information;
  • The name and contact details of the manufacturer;
  • Where applicable, the name and postal and electronic address of the responsible economic operator established in the European Union; and
  • Relevant warnings, instructions or safety information.

Where the manufacturer is established outside the European Union, online product offers subject to the GPSR must also display the relevant EU responsible person’s details. 

4. Placing an Order and Formation of the Contract

Products displayed on our website constitute an invitation for you to place an order and do not by themselves constitute acceptance of an order by us.

By completing checkout and clicking a button clearly indicating an obligation to pay, such as “Pay now”, “Buy now” or equivalent wording, you submit an offer to purchase the products shown in your order.

After placing an order, you will normally receive an electronic order acknowledgement.

An automated acknowledgement confirms that we have received your order but does not necessarily mean that your order has been accepted.

A contract between you and us is formed when we:

  • Send an order acceptance or dispatch confirmation; or
  • Dispatch the goods,

whichever occurs first.

We may decline an order before acceptance where, for example:

  • A product is unavailable;
  • Payment cannot be authorised;
  • The delivery address is outside our delivery area;
  • There is an obvious and material pricing or product error;
  • We reasonably suspect fraud, unauthorised payment or abuse;
  • An order exceeds reasonable purchase limits disclosed by us; or
  • Accepting the order would breach a legal or regulatory obligation.

If we have received payment for an order that we subsequently decline before acceptance, we will refund the relevant amount without undue delay using the original payment method.

We will provide confirmation of the distance contract and legally required information on a durable medium, normally by email, within the period required by law. 

5. Prices

Prices displayed on our online store are shown in euro (€) unless expressly stated otherwise.

Prices include VAT where we are required to collect VAT at the point of sale.

Delivery charges and other amounts payable to us will be displayed before you complete your purchase.

The total price payable to us will be shown at checkout before you place your order.

6. Goods Dispatched from Outside the European Union

Some products may be fulfilled or dispatched from locations outside the European Union.

Where this applies, import VAT, customs duties or carrier administration charges may apply depending on the value of the goods, place of dispatch and delivery arrangements.

The checkout and/or our Shipping Policy will indicate whether applicable import charges collected by us are included or prepaid.

Goods valued at €150 or less

From 1 July 2026, most e-commerce packages valued at €150 or less entering Ireland directly from outside the EU are subject to a €3 Customs Duty charge per applicable item or customs line.

Where this charge is collected at checkout, it will be included in the amount displayed to you.

Where it is not collected at checkout, the courier or postal operator may require payment before delivery.

Import VAT may also be payable depending on whether VAT has already been collected through an applicable arrangement such as the Import One Stop Shop (IOSS).

Goods valued above €150

Goods above €150 may be subject to applicable customs duty, import VAT and other charges depending on the classification and value of the goods.

A courier or postal operator may also charge an administration or customs-processing fee.

Irish Revenue confirms these rules and explains that the way the €3 charge and import VAT are collected depends on the seller’s checkout and import arrangements. 

Where an additional charge cannot reasonably be calculated in advance, we will provide the information required by law about the fact that it may be payable and, where applicable, the manner in which it is calculated.

7. Payment

Payments are processed through payment services available on our Shopify store.

Depending on availability, payment options displayed at checkout may include methods such as:

  • Visa;
  • Mastercard;
  • American Express;
  • Apple Pay;
  • Google Pay;
  • Shop Pay.

Available payment methods may change.

Payment is due when you place your order unless a payment provider expressly offers another arrangement.

Payment transactions may be subject to security, authorisation and fraud-prevention checks by the relevant payment provider.

8. Delivery Area

We currently deliver online orders to addresses in the Republic of Ireland.

Delivery restrictions will be displayed at or before the beginning of the ordering process where required.

Irish law requires online stores to clearly indicate applicable delivery restrictions and accepted payment methods. 

9. Processing and Delivery

Estimated processing and delivery times are stated in our separate Shipping Policy and may also appear during checkout or in your order confirmation.

Unless we agree another delivery period with you, goods must be delivered without undue delay and no later than 30 days after conclusion of the sales contract.

Products from the same order may occasionally be dispatched separately. In that case, you may receive more than one parcel or tracking number.

You will not be charged an additional delivery fee for a split shipment unless that fee was clearly disclosed and accepted before you placed the order.

Unless expressly agreed otherwise, delivery dates shown on the website are estimates rather than guaranteed delivery dates.

The statutory 30-day default and the consumer’s remedies for delayed delivery are set out in section 36 of the Consumer Rights Act 2022. 

10. Delayed Delivery

If we do not deliver within the agreed delivery period, you may require us to deliver within an additional period that is appropriate in the circumstances.

If we do not deliver within that additional period, you may be entitled to terminate the sales contract and receive a refund.

You may be entitled to terminate without providing an additional period where:

  • We have refused to deliver;
  • Delivery by the agreed date was essential having regard to the circumstances surrounding the contract; or
  • You informed us before the contract was concluded that delivery by a specified date was essential.

Nothing in this section restricts your statutory rights relating to delayed or failed delivery. 

11. Risk During Delivery

Goods remain at our risk until you, or a third party nominated by you other than the carrier, acquire physical possession of them.

We remain responsible for dealing with the delivery provider where the carrier was arranged or proposed by us.

An exception can apply where you independently commission a carrier that was not proposed by us. 

Please ensure that your delivery address is complete and accurate.

If you notice an address error after placing your order, contact us as soon as possible. We cannot guarantee that an address can be changed once fulfilment or dispatch has begun.

12. Ownership

Ownership of goods remains with us until payment for those goods has been received in full.

This does not alter the rules concerning delivery risk described above.

13. Right to Cancel an Online Purchase

For most physical goods purchased online, you have the right to cancel your contract without giving a reason.

The cancellation period expires 14 days after the day on which you, or a third party nominated by you other than the carrier, acquire physical possession of the goods.

Where multiple goods from a single order are delivered separately, the period generally begins when you receive the final item.

You may use the Model Cancellation Form contained in our separate Cancellation, Returns & Refund Policy, but you are not required to do so.

Irish law provides a 14-day cooling-off period for most online purchases. 

14. Returning Goods After Cancellation

After notifying us of your cancellation, you must return eligible goods without undue delay and no later than 14 days after notifying us.

Please contact us before sending the parcel so that we can provide the appropriate return address and instructions.

This procedural request is intended to ensure that your parcel reaches the correct returns facility. It does not restrict your statutory cancellation right.

For a change-of-mind cancellation, you are responsible for the direct cost of returning the goods, provided we have informed you of that obligation as required by law.

We do not charge a restocking fee.

15. Refunds Following Cancellation

If you validly exercise your statutory cancellation right, we will refund payments due to you in accordance with applicable law.

Where the entire order is cancelled, this includes the cost of our least expensive standard delivery option.

Additional delivery charges resulting from your choice of an enhanced or more expensive delivery option are not refundable.

For a partial cancellation, original outbound delivery costs will be refunded only where required by applicable law.

Refunds will normally be made using the same payment method used for the original transaction unless you expressly agree otherwise.

We do not charge a refund processing fee or restocking fee.

We may withhold the refund until:

  • We receive the returned goods; or
  • You provide evidence that you have sent them back,

whichever occurs first.

16. Customs Charges and Returned Goods

Customs duties, import VAT or courier administration charges paid directly to a customs authority, courier or postal operator are separate from amounts paid directly to Moira Dublin.

Whether those charges can be recovered after a return depends on applicable customs rules.

For goods valued at €150 or less imported into Ireland from outside the EU, Irish Revenue currently states that the €3 Customs Duty introduced on 1 July 2026 is generally not refunded by customs authorities where goods are returned solely because the consumer changed their mind.

Different rules may apply to faulty or non-conforming goods. 

Nothing in this section permits us to withhold any refund that we are legally required to make for amounts paid directly to us.

17. Exceptions to the Change-of-Mind Cancellation Right

The statutory change-of-mind cancellation right does not apply in certain circumstances provided by law, including:

  • Goods made to your specifications or clearly personalised;
  • Sealed goods that are not suitable for return for genuine health-protection or hygiene reasons once the seal has been removed;
  • Goods liable to deteriorate or expire rapidly; and
  • Goods that, after delivery and because of their nature, become inseparably mixed with other goods.

An exception applies only where its relevant legal conditions are satisfied.

These exceptions do not remove your rights where goods are faulty or otherwise fail to conform to the sales contract.

18. Faulty, Damaged, Incorrect or Non-Conforming Goods

Goods supplied by us must conform to the sales contract and the requirements of Irish consumer law.

Among other requirements, goods should:

  • Match their description;
  • Be of the quality and type agreed;
  • Be fit for their normal purpose;
  • Be fit for a particular purpose that you made known to us and that we accepted;
  • Correspond to any sample or model where applicable;
  • Have the qualities and durability reasonably expected of goods of that type; and
  • Be supplied with relevant accessories, instructions and safety information where required.

Where goods are not in conformity with the contract, you have statutory remedies. 

Fault reported within 30 days

If the goods do not conform to the sales contract and you exercise the applicable short-term right to terminate within the first 30 days, you may return the goods for a refund.

You may instead choose repair or replacement where you prefer and the statutory conditions are met. 

After the initial 30 days

You may generally choose between repair and replacement, subject to the statutory rules concerning impossibility and disproportionate cost.

A legally required repair or replacement must be:

  • Free of charge;
  • Completed within a reasonable time; and
  • Provided without significant inconvenience to you. 

You may be entitled to a proportionate price reduction or to terminate the contract in circumstances provided by law, including where repair or replacement cannot appropriately resolve the non-conformity.

First year after delivery

Where a lack of conformity becomes apparent during the first year, Irish consumer law generally presumes that it existed at the time of delivery unless the contrary is established or that presumption is incompatible with the nature of the goods or fault.

Longer-term rights

Consumers may seek remedies for faulty goods for up to six years from receipt of the goods, depending on the circumstances and what could reasonably be expected of the product.

The passage of six years does not mean that every product carries a six-year guarantee. The expected durability of the particular product and the nature of the fault remain relevant. 

19. Reporting a Fault

If you receive goods that are faulty, damaged, incorrect or not as described, contact:

Please provide where reasonably possible:

  • Your order number;
  • A description of the issue; and
  • Clear photographs showing the item and problem.

Requesting photographs helps us investigate the issue and does not remove or restrict your statutory rights.

Where the goods are confirmed to be faulty, damaged, incorrectly supplied or otherwise non-conforming, we will bear the necessary return costs where required by law.

Damage resulting solely from misuse, accidental damage or normal wear and tear is not treated as a lack of conformity that existed at delivery.

20. Sale and Promotional Products

Products purchased during sales, promotions or discount events have the same statutory consumer rights as other eligible products.

A discounted product is not automatically excluded from:

  • The statutory cancellation right for eligible online purchases; or
  • Your rights concerning faulty or non-conforming goods.

Promotional codes, bundle discounts and other offers are subject to any conditions displayed with the particular promotion.

Unless expressly stated otherwise, promotional codes cannot necessarily be combined.

Where a promotion offers a discount based on purchasing a specified number of products, returning part of the qualifying purchase may result in recalculation of the discount only where that consequence was clearly disclosed in the promotion and is permitted by applicable law.

21. Product Safety and Recalls

If we become aware that a product may present a safety risk, we may contact affected customers and take appropriate action.

This may include:

  • Providing safety information;
  • Giving corrective instructions;
  • Arranging replacement;
  • Stopping sale of the product; or
  • Arranging a product recall.

Customers should follow safety or recall instructions issued by us, the manufacturer, the relevant EU responsible person or a competent authority.

22. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for:

  • Death or personal injury caused by negligence where liability cannot lawfully be excluded;
  • Fraud or fraudulent misrepresentation;
  • Liability for defective products where it cannot legally be excluded;
  • Mandatory statutory consumer rights; or
  • Any other liability that applicable law does not permit us to exclude or restrict.

These Terms relate to consumer purchases and are not intended to exclude losses for which we are legally responsible.

We are not responsible for loss caused exclusively by circumstances for which we have no legal responsibility.

23. Events Outside Our Reasonable Control

We may experience delays caused by circumstances outside our reasonable control.

Where this occurs, we will take reasonable steps to minimise disruption and resume performance when reasonably possible.

Where appropriate, we will inform affected customers.

Nothing in this section restricts your statutory rights relating to delayed delivery, non-delivery, cancellation or refunds.

Please provide your order number and sufficient information to allow us to investigate the issue.

We will make reasonable efforts to respond and resolve complaints appropriately.

The Competition and Consumer Protection Commission (CCPC) provides information about Irish consumer rights but does not determine individual contractual disputes between consumers and traders.

We are not presently committed to participating in a particular Alternative Dispute Resolution scheme.

Where we subsequently become legally required or contractually committed to use an ADR provider, the relevant information will be provided.

Participation in ADR is generally voluntary for traders unless they have committed or are required to participate. 

25. Personal Data

Personal data is processed in accordance with our separate:

That Policy explains, among other things, how Corvi Group LLC trading as Moira Dublin processes personal data, uses Shopify, handles international data transfers and respects GDPR rights.

26. Governing Law and Jurisdiction

These Terms and sales contracts entered into under them are governed by the laws of Ireland.

The courts of the Republic of Ireland have non-exclusive jurisdiction over disputes relating to these Terms or purchases made through our store.

Nothing in this provision deprives you of mandatory consumer protections or any right you may have under applicable law to bring proceedings before another court having jurisdiction.

27. Severability

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed only to the minimum extent necessary.

The remaining provisions will continue to apply.

28. Changes to These Terms

We may amend these Terms from time to time to reflect changes to our business, website, services or applicable law.

The version in effect when you place an order will normally apply to that purchase.

Changes will not retrospectively alter an existing sales contract unless required by law or expressly agreed with you.

The latest version will be published on our website with its revision date.
